- This notice is issued by Alderley PCG Pty Ltd trading as Breathe Residences Alderley (‘Breathe Residences’, ‘we’, ‘us‘ and ‘our’) and applies to the entire contents of this website, any correspondence you have with us and our marketing materials (to the extent that there is no inconsistency with other express terms and conditions). Please read the following terms and conditions carefully.

We reserve the right, at our sole discretion, to update, change or replace any part of these terms and conditions.
Disclaimer
- No warranties. This website is provided “as is”. Breathe Residences makes no representations or warranties (express or implied) in relation to this website, its availability, or the accuracy or completeness of the information and materials provided on this website.
- The photos, images, designs and illustrations (Images) contained on this website and in our marketing material have been produced prior to detailed design and construction, are indicative only and do not constitute a representation by Breathe Residences, its employees, agents or consultants. Without limitation, this includes any representations in respect of the size, form, dimensions, measurements, height of the building, number of levels of the building, specifications, finishes, design options and upgrades, or layout of the unit/s at all. While the Images have been prepared with due care, the final product may change from that illustrated and items may not be included in the advertised base price or are not supplied by Breathe Residences. Furniture and furnishings are not included. All furniture shown and all graphics including flooring and tiles are for illustrative purposes only. Artist’s impressions, sketches, floor plans and the project specification may depict and/or detail upgrade options which are not included in the purchase price unless noted in the contract of sale. Changes may be made to the design and layouts during development and construction in accordance with the provisions of the contract of sale or the building and/or planning requirements or for compliance with relevant standards or codes. Purchasers should speak with a Breathe Residences consultant or sales agent for further information on detailed pricing prior to making a decision to purchase.
- Time, distance and maps. Any references to time and distance throughout this website are approximate only and have been calculated based on the most direct route and assuming no adverse traffic conditions. If the time and distances are important, purchasers should make their own investigations. Maps are for illustrative purposes only and may not be to scale.
- Third Parties. Breathe Residences makes no representations on behalf of, nor does it provide any guarantees in relation to, third parties including its partners. Prospective buyers must make and rely upon their own enquiries.
Limitation of Liability
- Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or other consumer protection laws in Queensland which cannot be contracted out of (Non-Excludable Guarantees).
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Breathe Residences (including its officers, employees and agents) will not be liable for any liability, for any personal injury, or any loss or damage, whether direct, indirect, special or consequential, arising in any way as a result of you or anyone acting or refraining from acting in reliance on any information or materials contained on this website or in Breathe Residences’ marketing materials.
- By using this website, you agree that you will not bring (or procure a third party to bring) any claim against Breathe Residences (including its officers, agents or employees), on or substantially on the basis of any liability on the part of Breathe Residences (including its officers, employees and agents) which is excluded by these terms and conditions
Intellectual Property
- Breathe Residences is the rightful owner of the Images and other creative material depicted on this website and its marketing materials. You agree not to reproduce, duplicate, copy, sell, resell or export any portion of the intellectual property viewed on this website or Breathe Residences’ marketing materials, without express written permission from us.
Jurisdiction
- This notice shall be governed by and construed in accordance with the laws of Queensland, Australia. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
Severability
- In the event that any provision of these terms and conditions are determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms and conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
